    BK Filing Surprises

    I thought we were pretty well prepared for what would happen when we filed BK.

    We went Tues, Sept 12th to review the Petition. There some minor corrections that needed to be made. Mostly updating Debt info from new CC bills that had come in. So we went ahead and signed the paperwork.

    Our paralegal emailed us Thurs that the Petition had been updated, the attny signed, and the Petition was filed on Sept 14th. I checked PACER, sure enough we were filed. The rest of our schedules didn't get posted until earlier this week.

    On Saturday, we got a mailer from a car dealership offering us special financing for Ch 7 Filers. We had to act quick as this was time sensitive. We hadn't even discussed financing a vehicle during our BK filing with our attny.

    When our Schedules got posted on PACER, I noted that both the County and the State Depts of Revenue were also notified on the Court Clerk's list of Creditors contacted, either by mail or electronically. We don't owe any back taxes to either the State or the County and we didn't list either one on our Creditor's Matrix. Is this just SOP??!!

    Next came the post card mailer from a Debtor Education service. "Everyone Passes" it said for the low, low fee of only $39.95! Unreal.

    Yesterday, we both got mailings from the Court about our Scheduled 341 Meeting. So OK! Now our Postal Carrier must know we've filed.

    What's next??!!

    Discharged - 12/2006
    Officially Declared No Asset - 03/2007
    Closed - 04/2007

    SK, In one of our meetings with our attorney, he mentioned that all tax agencies would be notified of our filing even if we didn't owe any taxes. I thought it was strange myself, but he says its the law now. Sure hope all goes well for you, we will be filing 9/28

    10/25/06: 341 meeting Done!
    12/25/06: Last day for objections.... Dear Santa, can we have a bk discharge for Christmas please?
    1/12/07: Discharged & closed!!

      Hi SinkingFast,

      I noticed the same thing when we filed, even the IRS was notified! (something about the BK estate having to file a seperate tax return in an asset case, which I believe the trustee does)

      Don't worry about the mailman, for all he knows someone owes you money and filed BK on you! I bet they see so much mail, they don't even look at who it's from!

      Sounds like everything is moving along for you, and I bet it will go smoothly!

        Yep, the financial vultures that prey on the newly bankrupt are out in force checking PACER daily M-F. The car dealer probably knew you filed Ch 7 ten minutes after the case was uploaded and had the letter in the mail....sigh...

        Since we filed Ch 13, we didn't get any of the vulture literature after filing. However, I understand our financial come-ons will start arriving in the mail around 6 months before the end of our plan. I don't think these guys miss a step.

          i get lotsa car mailings.

          Total joke. They offer nothing special that i can't get by walking down to the dealership of my choice. Like they're gonna offer only me some outrageous bargain. uh huh.

            Yup, it's SOP. IRS, State Tax Board, etc all get notified, regardless of whether you owe money or not. Here in Nevada, the IRS, Nevada Labor Commission, and Nevada Dept of Taxation were all served. My attorney says it's required under the law.

            There was a problem with my initial filing (attorney neglected to send in C13 Plan), but by the time I looked it up on PACER it was already taken care of. I guess at this point it's just a matter of waiting to see who challenges, or whatever happens next. Just roll with the punches!
