I live in Pa. I filed for BK7 4/2004 discharged 6/2004. My house was included in BK7. My mortgage company was Centex. In 9/ 2002 Centex filed a judgement for $42,514. They filed another judgement for $51,964 in 12/2003. There was a sheriff sale in 11/2005. I called sheriff office and was told the house was bought for $838. From what I understand it was Centex that bought it back. They have it in the hands of a realator and it hasn't been sold yet. I have not received a notice of another judgement for the deficiency. Centex is now called Nationstar. Nationstar is reporting that I have a mortgage with them and even checked my credit report 6/2006. Does this seem right?

If the mortgage was included (not reaffirmed), then it was disharged and should not be showing on your CR. You must dispute this and have it corrected.Bankruptcy History:
Chapter 7 filed - 10/12/2005 - Asset
Discharged - 02/16/2006
Case Closed - 11/08/2007

Since you filed bk you are not responsible for a deficiency balance. They may try to say that you are but if you included it they cannot come after you. Your credit may be trashed for awhile (mine certainly is!) but you cannot be held accountable. Many of these mortgage companies are getting upset because so many people are filing bk, at least where I live.

Bankruptcy before foreclosure
If I am not responsible for the deficiecies I should dispute the judgements how. They both were entered before the foreclosure. Shoule I ask judge to dismiss them. If anyone can help me I would be grateful. I have 2 judgements, bankruptcy, 1 mortgage after they foreclosed on the house. This is all from 1 mortgage that was a predatory loan in the first place.
