    Developer wants our house

    We have 5 months left on our chap. 13, we were able to keep our house, now a developer wants our property, we don't have a choice. Will the trustee get to keep any profits that we get if we don't sign it will go into eminant domain and we will lose everything. Can't find anyone who has been in this situation.

      At a minimum, the trustee will probably get the balance owed on the plan. Also, even w/ the threat of eminant domain, you will still have to petition the court for permission to sell your house. Thus, you should make contact with the Trustee and/or your attorney if you used one.
