      You don't know what this means to me.

      I am a bundle of nerves. Can't wait until it's over that's for sure!!

      I spent Sunday and part of yesterday gathering everything together to take with us just in case our attny gets asked for anything.

      I checked the Court Docket. There are 8 Ch 7 BK's tomorrow. 7 in the 9:00 am time slot. One scheduled for 9:30 am. We're the last in the 9:00 time slot. Our attny has a block of 4 and we're his last case for the morning.

      Fingers crossed that all goes well.

      God watched over us the last couple of days. Daughter broke down in the car yesterday. The engine overheated. Fortunately some nice people helped her get it cooled down and she wasn't far from the shop to get the car to the mechanic. THEN we got lucky that the engine didn't burn up. The mechanic said he's seen much worse damage but our car seems fine. It was a bad radiator cap so it was a relatively cheap fix.

      Praying that God watches over us tomorrow as well.

      Gee, I hope that isn't asking for too many favors in a row??!!

        No way, SF! You truly deserve a smooth sailing 341.

        Remember that no matter what happens, we'll all be here for you whenever you need support just like you are here for all of us when we do. Thumbs up - all will go fine, I'm sure of it!

                  Well,.............. It was interesting, that's for sure.

                  And it was raining again. Just like the day we signed out petition.

                  We had to go thru a metal detector. Hubby had trouble. He kept setting it off. He had emptied out his pockets already, so they had him start stripping right there. First off with his jacket. Then off with his belt. He finally got thru the metal detector. Hand wand over his jacket. It was a pack of gum in his jacket pocket that set off the metal detector. Ran his belt thru the X-Ray machine. It was his belt buckle there. Sheesh, they sure had the metal detector set down real sensitive!

                  Then they didn't even send us into the main Court Room. The 341 Meetings were being held in a room downstairs. We were "escorted" into an elevator and taken down stairs by a Federal Marshall. A Federal Marshall sat in the room during the 341's as well.

                  Our attny showed up early. I heard him talking with another client out in the hall. When he got finished with her, he called us out into the hall to chat with us. Told us what questions the Trustee would ask, what to expect. I gave him the printout of our bank acct from the day we filed.

                  The Trustee came in and started the 341 Meeting about 5 minutes after 9:00 am. He said basically the same thing that our attny had out in the hall. The Trustee did place particular emphasis on income tax refunds. Referred to them as a "savings acct". That income tax refunds were money that would be owed to our Creditors.

                  Then the Trustee called roll of the filers that were supposed to be at the 341 Meeting. Amazingly enough, a couple of people weren't there! We were supposed to go next to last, but because of the no shows, our attny's block of clients got booted up. We were 5th.

                  We got thru all the questions just fine. The Trustee asked about bonuses where Hubby works. Hubby said he wasn't aware of any bonus program. The Trustee and the attny looked at each other and joked about if there would even be money to pay employees, much less bonuses. Hubby's company is in financial trouble so evidently, the Court is aware of Hubby's Company's financial woes as well. Small town. Everybody knows everybody's business.

                  Our last 2 years of income tax returns caused a bit of a problem. Because we got a big refund in '04 (severance) and then owed a large amount in '05 (retirement IRA), the Trustee is gonna hold our case open until he sees our income tax returns for '06. "After everything settles down and returns to normal." the Trustee said. Other than the tax refund issue, everything seemed fine and the Trustee told us we were excused. Our discharge date is set for December 11, barring any unforseen inquiries from the UST's office.

                  Since we were his last filers, our attny walked out with us. I had offered him Hubby's most recent 2 paystubs before the 341 but he said he didn't need them. As we were walking out, the attny asked to see the paystubs again.

                  Our attny told us to jack our exemptions up to 10 or 12 for the remainder of the year. Try and get our Federal withholdings down to $0/mo for the next couple of months. Then when we file next spring, we'll either get no refund or owe a little. The attny said to set aside what would have been withheld so if we owe, we'll have the money to pay. That way, the Trustee won't get any money at all.

                  The attny did say, the Trustee is interested in refunds of $1000 or more. That's what he goes after. That's pretty consistent with what others have posted here that they have heard as well. I asked if we could file electronically and set up for direct deposit. Our attny said that would be fine. Just be prepared to have to hand over 75% of any refund we get if our refund is in excess of $1000.

                  Whew! We got thru that part! And now we wait. Here's hoping for a very good Christmas present!! Being officially debt free!

                    Glad to hear your 341 went smooth. I'll bet your glad to jump over this hurdle. Now kick back and relax with us for the 60 days. Dec.11th will be here before you know it.

                      Breathing a sigh of relief for you, SF!! I would have been a complete basket case if the metal detectors had done that to my Dh or me on the day of our 341 mtg.!

                      Praying that you will get a wonderful Christmas present of being completely debt free.

                          Whew Sinking Fast, the hard part is over!!! I cannot believe that people would not show up. I really cannot imagine that. It was raining when I walked out of my 341 meeting and I felt so depressed. The weather today (in Indy) us depressing, and it supposed to get cold. Oh, how I want to move back to the south!!!!

                              Congrats SinkingFast! I'll never forget how relieved I was when my 341 was over! Glad to hear it went well.

                              We had similar problem with the metal detector, plus they took away both our cell phones.

                              I can hardly believe that on Friday it will be ONE YEAR since we filed
                              (seems like yesterday )
