    Telling Creditors Anything

    Hi all! Finally got my divorce started..if anyone remembers when I posted before, I had posted about starting a divorce and it's now underway. My attorney wants to get it filed, support started, and then get on with the bankruptcy. The divorce will be put on hold due to the bankruptcy being an entirely different matter and has to be done first. He is doing both the divorce and the bankruptcy.

    Do I need to let the creditors know I am doing this? I'm 20K in debt and the letters are coming. I know they know I can't pay them due to no payments from me in a couple of months. I had my phone shut off and use my cell phone only. They can't call me now..but the letters are coming..wow!

    Will I get in trouble for not responding to the creditors?

    Do I just wait it out until the filing begins? Which should be as early as Dec 1..any advice?

    Sorry about the divorce, HopefulOH. In the vast majority of situations, you have about 5-6 months without paying your credit cards or non-secured loans before they start mobilizing for court. Now secured loans are a different story - they typically will start foreclosure or repossession proceedings after two missed payments.

    Do not talk to your creditors and do not pay them anything unless your lawyer recommends that you do so. Contacting them directly by phone or letter can create problems if you say the wrong thing, even by accident. Most creditors record phone calls and are more than willing to use the recordings or letters if it's to their advantage.

    Talk to your lawyer and see what he/she recommends. Hang in there - things will look better once all this difficult stuff is behind you. Remember we're here for venting as needed. Keep us posted on what is happening with you, ok?

    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      Thanks - appreciate the words.

      I tell you - I've been so depressed here lately knowing I hardly have 2 cents to rub together.

      With the divorce I feel so alone, then you have the bankruptcy which makes me feel so violated, for my life and financial problems are so personally seen by the courts. I feel so embarrassed and ashamed of getting in this hole, but I have had to raise my 16 year old for the past 14 months all alone without hardly a dime from my stbx...I just feel so beaten up.

      On top of all this, I just found out yesterday I have 2 very large ovarian cysts on my ovary which is making life almost unbearable due to the pain. I'm in peri-menopause and no longer ovulating.....saying to me that middle age is upon me.

      Just feel out of sorts........I pray for all this to be over soon. I don't know how much more I can take.

        So to hear about the medical problems...... hopefully that can be resolve shortly also....

        Glad to hear your attorney is handling divorce and bankruptcy also..... that why he KNOWS everything and can work in your best interest.

        You vent whenever you need too - we are good listeners.........

        Bankruptcy is very hard and scary without a divorce thrown in the mix.......

        Talk with us, we'll support you, offer suggestions, and be there for you......

          Hi Hopeful, I wondered how you were doing. Glad to hear your divorce is started but sad for you that it's ending if that makes sense. You have ALOT going on right now. It's enough to put anyone over the edge. We will help you get through it all. You're doing a great job with your daughter and someday she will realize how much you have done for her and how much "he" hasn't. Hang in there hun. *sending well wishes your way*. Good luck with the cysts.
