    Husband About To Quit 2nd Job~

    Oh no~ here goes guys~
    My husband works two jobs, as most of you know...he has done so for over 5 yrs. as we were trying to pay off our debts with this so called extra income~
    we have NOT filed YET~ but are in the process.....have done the means and shedules....we are looking at a 2300. x 60 month payback ......
    HOWEVER~
    we asked our attorney "what if we decide to quit one of the two jobs....what would happen...." she said..."well, certainly NO trustee/judge or otherwise expects you to work two jobs, and if you quit or one of them becomes non existant for whatever reason, we will ammend your payback"~ ....but in mean time the "waiting period" that we are in...(.planning on filing in Dec.) one of my husbands jobs is looking bleek.....the hospital that he works for is slowly but surly "going under" .... and he is fed up with all of the BS that is going on there....it is draining him, as is the BK process......so, he is trying to decide whether to just GO AHEAD now (like in two weeks) and quit.....

    I'm guessing that we would need to "Wait another 6 months to file" as this would produce a LOWER income.....thus our payback would be lower......
    I feel he should tell the attorney NOW before he literally makes the decision to quit to see what her opinion is.....should we wait another 6 months....or proceed to file in Dec.
    There is NO WAY that we would be able to pay the 2300. monthly payback should he quit the job....and I don't want to "ammend" our situation.....that sounds like a headache and a half if you ask me....I think he should quit and then we should wait to file (hopefully we can) until it brings our income down.....what do you guys think???????

    Asking your lawyer's advice before quitting job #2 is a good idea, cab. Since your husband is not going to be fired tomorrow, waiting a few more days might be difficult but then he'll be making the decision with knowledge, not by impulse that could put you in a worst financial spot than now.

    However, I have to say for your husband's sake, I hope she says quit tomorrow! Waiting six more months to file to get your incomes at their lowest levels for filing has to be better than the exhaustion and stress of your husband having to keep up the extra job that the trustee won't expect him to keep for five long years just to make a huge monthly payment! Better to bite the bullet now and get it over with....my $.02 (and may not be what your lawyer recommends).

    Even if you can't wait six more months to file, your lawyer can always file a motion to amend your plan when your income does fall after hubby quits job #2. However, that could be very tricky to sort out as your income abruptly drops after job #2 disappears. You might get caught waiting for the trustee to approve dropping your monthly payment. When you have this discussion with your lawyer, be sure to ask how long it typically takes the trustee to approve an amended Ch 13 plan in your bk district.

      I know the feeling CAB. It's actually eerie how similar our situations are. I've been working 2 jobs for about 5 years now, trying to climb out of the debt, and it is really taking a toll on my family life and health. Nothing is worth that, I've finally decided. Good luck with it.

        I think many people do try to work their way out of debt first ROE before turning to BK. We figure if we're young enough, and lucky enough to be able to find a second job that pays well, we certainly willl give it a shot!
        My sweet husband has busted his butt trying to get us out of the mess, and it's helped some, but it just isn't getting us there fast enough.
        He is SO tired, and it is affecting his health at the point where I have told him he needs to stop, he feels that he should continue, but knows in his heart he probably can't do it~and I feel he just plain shouldn't!
