:confused: I live in Ohio. Today I received my Chapter 7 discharge papers. I filed Chapter 7 in mid March. Included in my bankruptcy was a modular home that is in a mobile home park and a vehicle worth twice the loan value.
I moved from the home in late March and volunteered to turn it over to the lender. They filed for a relief from stay which was granted at the beginning of May. Starting in June, they sent me several certified letters regarding the debt and one that stated the home would be sold at auction July 6th. They also sent me a letter stating the modular home had been repossessed.
Just over a week ago, I received a tax bill from the county auditors office for the personal property taxes on that modular home. The enclosed letter from them stated that they knew I was in Chapter 7 (I'd included the personal property taxes in the bankruptcy), but that I had to pay the first half of the tax bill. I called the auditor's office to inquire about this and they stated that the taxes went with the home and that the home had not changed ownership.
Though I paid the lot rent through May, I did not pay the June or July lot rent. The mobile home park, though they had my new address, has continued to mail the bills to the address where the home sits. I was on a month-to-month lease and they were made fully aware when I moved from the home in late March. Further, these bills have included water, sewer and trash pick up charges even though the water and other utilities were turned off and the trash has not been in use.
On the advice of my attorney (currently on vacation), I discontinued homeowners insurance on the property July 16th. The mortgage company has since sent me a letter demanding that I show proof of insurance.
Question: Since I received the discharge, what responsibilities do I have, if any, to the mortgage company in terms of the property and insurance, the county auditor for personal property taxes, and to the mobile home park for lot rent? When can I expect the mortgage company to take possession and get the home out of my name?
In regard to the vehicle, the credit union also moved for a relief from stay in early June. I did a voluntary repossession in which I returned the vehicle to the credit union. They then sold it for approximately half of what is owed. They have continued to show the vehicle as delinquent for the remaining balance.
Question: What should I do about the debt on this vehicle so that they do not continue to show it as past due and follow through with the discharge of the debt?
Interestingly enough, the discharge papers indicated that two creditors were not notified of the discharge...the mortgage company and the credit union...due to insufficient addresses. Adequate addresses were provided for both. What should I do about this?
