    Hello all
    I am in the foreclosure process ( I have until 11/27 to answer the summons/complaint I was served) but was surrendering my home anyway in my Chap 7 to be filed 12/8. Today, I had a message on my phone from my mortgage company (a real chipper sounding guy..lol) who asked me to return his call. my question is, they have already served me with the summons/complaint..why would they be trying to contact me? I didnt know if I should return his call or just ignore it and proceed with everything on 12/8 (the BK). My attorney had told me last week not to tell them anything more. But, I think he meant not to tell them anything more regarding my BK filing.
    I would appreciate any thoughts you might have on this.

    I understand that a part of you wants to know what's going on with your Lender. So it's tough to say don't call them.

    Remember that you're in the very first stage of a lengthy Foreclosure process. By filing so soon, you could easily be Discharged and Closed long before your Foreclosure is completed.

    If you do call to see what they want,............ I'd say, be VERY VERY careful what you do say to them. They can turn any tidbit of info you give them right around and use it to their advantage against you.

    Be prepared to give them your attny's name and contact info if the conversation leads in a direction you aren't comfortable with. That's if you do decide to call.

      Thanks Sinking. I think I will just let it ride and not call them (although you are correct in thinking that I am curious as to what they want!). I am going to see my lawyer next week and I will let him know as well, that they are trying to contact me.
