    Filed Pro Se and Need Help

    Okay I filed Pro Se and was told I didn't include a statement of intention which is due 12/14. But I get the form and realize I have no assets no leases no nothing so IMO none of the boxes pertain to me so do I just leave it blank and sign the bottom?!?!?!

    Here are the 3 options:
    I have filed a schedule of assets and liabilities which includes debts secured by property of the estate.

    I have filed a schedule of executory contracts and unexpired leases which includes personal property subject to an unexpired lease.

    I intend to do the following with respect to the property of the estate which secures those debts or is subject to a lease:
    Discharged... 2/13/07 Closed... 2/20/07
    Ochard Bank $600 Household Bank $600
    Hooters Card $1000 Target Store Card $500
    Discover HSBC $300

    Sorry I was having an anxiety attack on this side and realize the answer is BOX 1 if I would have just referred to my Nolo book b4 I posted I would have read that as clear as day.

      If you don't have any loans on any of your assets, but you do have a lease, then you check boxes 2 and 3.

      Under Box 3 on the Leased Property line, you fill in a description of the leased property with you as tenant, the name of the person/company who's hold your lease, and put an X in the box "Lease will be assumed persuant to,........."

      If you have a loan and lease, you would check all three and fill in the appropriate info for the description of the Secured property as well.
      Filed Ch 7 - 09/06
      Discharged - 12/2006
      Officially Declared No Asset - 03/2007
      Closed - 04/2007

        Wait im confused...

        I don't have a loan or a lease I live w/ parents gave up my apt. so what would YOU check off if that was your case and I don't have any secured debt.

          If you don't have any secured or leased property then just fill in the caption at the top of the page and leave the rest blank.

            That's a very good question!

            We didn't have any debts secured by property of the estate. It was all CC. No house. No car. No furniture loans. All we had was the Lease on the Condo we rent.

            I'm guessing the Court just wants Form 8 on file as part of your BK Petition, Schedules, and Forms.

            If that's the case, fill in your name as used on your BK Petition, the Case # and Chapter you filed. If you have no property securing debt and no Unexpired Leases or Contracts, you'd leave the rest of the form blank. No boxes to check and no info to fill in on the lines at the bottom.

            Hopefully someone will give the correct info if that's is wrong.

              Agreed - I was in a similar situation and that's what I did (I filed pro se). It was never questioned.

                  I know it's hard to relax but really it'll all turn out OK.I filed pro se too.It's very nerve wracking attending the 341 meeting but you'll be in and out in no time.When I had my 341 I went in very well prepared.In fact I brought way more than the Trustee could have possibly asked for but It helped to know I was prepared in case he asked for documentation on anything I listed on my petition.But nope...just asked the basic questions and said 'have a nice day'.

                      Princesskina,NO.No.You'll be Ok.When I got there I took a few deep breathes and walked in.There were two other people filing pro-se and two couples with attorneys with them.Well actually the second couple told me their attorney was late.They looked really nervous.I was in and out in 10 minutes and that couples attorney had not arrived yet.I felt bad for them.
                      You'll be fine.It's a breeze.Just bring your paper work and answer all the questions the Trustee asks you honestly.He'll say 'have a nice day' and your done!! I skipped all the way out of my meeting....well,not really but I certainly felt like it!
                      Remember,Take a deep breath and relax.It's not the big deal alot of people make it out to be!
