We are a little confused as to why our vehicle reaffirmation has not been filed on Pacer. CapOne sent our lawyer the reaff paperwork, we signed it, and I am assuming it went back to the lender and then on to the Trustee? We were discharged several weeks ago, but are awaiting closing while the Trustee goes after equity in our house (still unresolved but looking like we will win, long story).
Anyway, is there a deadline for the Trustee to agree/file it or not? This payment was obviously included in our bk filing, and if we did not have it included, who knows what that would have done to our means test.
CapOne Auto Finance made it crystal clear that if we didn't want to sign the reaff, hand over the car. Period. We are currrent, never missed a payment, and didn't matter to them. This is our only car, so we chose to reaffirm.
Any ideas? What happens when the Trustee doesn't agree to the reaffirmation (how often does that really happen)? I guess the lender would contact us (in our case) to get the car? Since we are discharged, I am assuming the Trustee "agreed" with our car payment at one time?
