    Help! Co-signer question!

    Hi!
    New to the forum, just filed chapter 7 on Wednesday. My problem is
    my dad opened a student credit card account with Capitol One for me seven years ago with a $500 credit limit. In the years since, the limit was raised to $4,000 and was upgraded to a gold account. However, I was completely unaware that he possibly co-signed all of these years, until my dad asked me this morning why he was getting calls from the collection agency, NCO. He said that they tried to bully him into paying, said that he was a co-signer on the account, but did not know his SS# (they asked him for it, he didn't give). NCO has my parents' phone number because it was the original number on the account.
    They're threatening my dad's good credit because of my delinquency.
    My question is: I know that as a co-signer, he would be liable to pay the debt in the event of my bankruptcy, but I am not completely sure if he is really a co-signer or not. My attorney told me to ask NCO for a copy of the orignal letter with my dad's signature on it. I haven't had a chance to do so yet. Question 2 is, the bills and account were always in my name only. When Capitol One themselves attempted to collect (over a period of 3-4 months), they never once called my father, only me. I would think that if there were a co-signer on the account, then surely the original creditor would have tried to contact them! Hopefully, someone out there has had this same kind of situation and would offer some help please!

    My guess is that if he did not supply a SS# he is not a co-signer, but do check with Capital one and get a copy of the original application, also I can share this with you, when I went through my BK I stopped answering calls and one of my accounts went to a collections agency and they tracked down my dad that lives 1500 miles away and started calling him, so they will try any way they can to get money from you or your family, if you have already filed these type of things should stop shortly.
