Hubby and I haven't filed yet. Haven't paid on the cc per attny in 3 months. Will be filing in 3 more months.
Can cc companies plan a lien on our house (not paid for)?
Yes they can however first, they have to take you to civil court, then they have to win a judgement against you FIRST, then they have to wait 10 days after they get a judgement and then they can put a lien on your house, garnish your pay, and freeze your bank accounts.............most credit card companies don't really take legal action until your 6 months late. most don't turn it over to collections until 6 months, of course every company is different.
It depends on where you live. Some states don't allow leins on houses and garnishments on wages. Many allow bank account freezes. Look up the exemptions for your state. I may be mistaken, but even if they do a freeze or lein, once you do your BK, the judgement is removed and the lein will be removed as well.
I concur with sisterfunkhaus. The important thing is to file a Motion to Avoid Lien in the bankruptcy case.
