Hi, I have a pending lawsuit from a accident 2 years ago which has led to the need to file bk. I need to know if I can file a 7 or 13. I have heard in both cases the trustee might take over case. Live in Georgia.

To help with your questions we need more information...
*Was the accident your fault?
*Did the accident involve drinking?
*Who is suing you?
*Has the accident case been scheduled for a date in court?
*What is your total income for the last six months? (include all sources)
*Do you have others besides yourself living in your household?
*What are your assets? Do you own a house? Cars?
*How much total secured debt do you have? (mortgage, home equity line, auto loans, etc)
*How much total unsecured debt do you have? (credit cards, unsecured loans, etc)
