    Have received an offer on family home but find myself in a mess because of my bankruptcy. First offer fell through escrow because of problems with title and my bk. Now I have another potential buyer.

    Can or will the Trustee force me to payback all my debts which were discharged in bankruptcy if he finds out that I now have title to a house which if sold would have enough proceeds to pay off my creditors?

    My brother had lost title to our family home over a mere 3K title loan. I begged and borrowed the money and repayed the loan + interest. He agreed to put the house in my name to keep it safe from his gambling habit and also agreed that we should sell it as well. I took title to the family home after I received notice that my BK was discharged which I thought meant "over, done, finito." I did not know that "discharge" and "dismissal" are different things, this was never explained.

    When I went to consult with my BK attorney after receiving a letter from the Trustee stating a motion would be filed to collect 3yrs of tax refunds he never explained that the Trustee could effectively keep my BK file active by continuously filing motions. Nor did he say that I should not have the house title in my name. I told him what I was doing. I even sent him a fax confirming our conversation.

    Currently, I am making payments to the Trustee through a stipulation and until that is over I will not be given a dismissal.

    I am troubled because the BK attorney is telling me not to let the Trustee know about the house. Am I breaking the law by not telling the Trustee about the house and pending sale? Unless I have a dismissal letter or a letter from the Trustee stating that its alright to sell house, Title will not approve escrow. Even if I were to scrape together the money to repay the tax refunds, how long after that before a dismissal letter is issued?
