Income Question Chapter 7

We have just filed Chapter 7 but I am confused on the whole income thing.

My husband works overseas, and we do have good income, but our debt is just too high. And, due to job loss earlier in the year, we fell so far behind we were just struggling to swim upstream.

The job he got was a blessing, but it is only temporary until July of 2007. In the meantime, my income is always better in the fall because of holiday sales so mine will be significantly lower now.

So, for the last 6 months our income has been very good, but it is definately expected to drop again. Since they go by the previous 6 months, could they force us into Chapter 13?

The attorney said they would try and push it through as a Chapter 7 and that because of the dual living expenses it should go through but I am afraid when the judge sees the income, he won't agree.

And advice or experiences?

Is it possible to wait a couple of months to file while your lower income can be figured in?

Shouldn't the attorney know better? Why would she say could push it though as a 7? I didn't even question it until I started reading some of the posts here actually.

Won't the judge see where is asks 'is your income expected to change'...or does that no matter? Is it just strictly by the previous 6 months income?

We have already filed now...isn't it too late to wait now?

oops sorry, I overlooked the part where you already filed. I am not sure about the attorney thing because we went pro-se. But we did consult with a couple of attorneys and one even took a couple of extra calls with questions even after he knew we were filing pro se. Hopefully your attorney knows what he is doing and can make it work for you. Good luck.
