    341 on Wednesday....boy my knees are knocking!

    We officially filed our paperwork back around 11/9 and due to our lawyer being out of town when we would have had our 341 (mid December), she filed a continuance so our date is now 1/10.

    Ours is definitely a no-asset case - we have something like $13,000 in assets (including the equity in our house), and almost $60,000 in unsecured debt - but I'm still horribly nervous. The thing I'm most concerned about is the trustee asking about my internet business I ran in 2004 and 2006. Mostly I sold items from around the house on eBay to earn a little extra cash...usually no more than about $20/month after taxes, expenses, and so on. I kept track of things on a simple spreadsheet (listing itemized income and itemized expenses), no fuss, but I'm still scared to death that he's going to say that it wasn't good enough and dismiss our case.

    Any words of encouragement would be so welcome . Our hearing is at 9:30, so hopefully by 10:00 Wednesday morning DH and I will have lifted a huge weight off our shoulders.

    Don't fret, nervous&sure! I had income from a few odd and end jobs in the year before filing, but it wasn't an issue at our 341. At the time of filing, our income was below the median, so no one cared where the income came from or who made what. It's not the Trustee's job to question why you're there - and it doesn't matter if you had a net worth of $2 billion in the past as long as you met the Chapter 7 requirements in the 6 months before you filed.

    If you can, go a little early and listen to some of the hearings before yours. We listened for close to an hour and were instantly put at ease - the Trustee asked the exact same questions of everyone, and it was 3-4 minutes tops.

      My attorney who is also a trustee commented that the current case load is 7-8 cases per 30 minutes. So, you are not going to get grilled in detail about every little thing. If your filing shows complete cooperation, it is an in-and-out thing.

        I'm no expert, but my opinion is not to worry about it. I don't think either that you will be grilled in detail. I wish we could have watched at least a few other couples before us, but we were the second ones. Actually, we were slated to be the VERY first ones, but the trustee decided to take another couple ahead of us. They were the only ones we got to watch and listen to. The trustee asked us the exact same questions that he asked them. I wish I had been less nervous and noticed what time we were called and what time we were done. I couldn't believe how fast it went. It must have only taken about 2 minutes. Then at the end, the trustee said it's a no asset case. One thing that doesn't relieve my mind is that the lawyer (I hope he's telling us the truth) said none of his clients filing bankruptcy ever had any trouble, and he also said that the trustee is easy-going. He seemed that way at the meeting, joking around with the lawyers and stuff, not all business. I'm glad it's over, and I honestly can say that I worried way too much about it beforehand. My husband did answer something wrong at the meeting, which I'll have to ask our lawyer about that today, but according to people on here, it shouldn't be a problem. Good luck and try not to worry too much.

          Thanks so much, everyone. Your replies really do help. Now I'm eagerly counting down 72 hours when we'll (or should) be done and counting down to discharge - which conicidentally is just a few days after my birthday. That'd be the best darn birthday present I could ask for, that's for sure!!
