    Chapter 13 Dismissal

    My situation is so complicated I don't know where to begin but here goes....
    A few months ago I asked for advice on this forum because I was running behind on my payments to the trustee. I took the advice and called the trustee and negotiated but a few days later received a notice stating they would dismiss my case if I did not sign a conditional form.

    We did that and had to pay $690 plus the $518 (our reg monthly payment) for the next three months until we caught up the $2,070 we were behind on. Everything went as planned until two weeks ago when my husband's car broke down on the freeway and two days later my mother-in-law had a stroke and we had to leave town unexpectedly. I had gotten the money order while we were out of town for the last payment of $690 plus our regular monthly payment but did not send it because I was busy trying to get my mother-in-law care situated.

    Anyway, we got back on Monday, March 20th and found a letter in the mailbox from the trustee stating our case was dismissed due to none payment of $690. We called immediately and the jerk (our case manager) did not want to hear or accept our payments and told us to call our lawyer which we did.

    After talking with our former attorney who by the way could not take our case because she is overloaded advised us to find an attorney right away. We are only $11K in bankruptcy because $10K has been paid out to our creditors. The bulk of the debt is with our mortgage company ($8K) Chase Manhattan and the remaining is IRS. I don't want to file for bankruptcy again because it is such a hassle and we have to pay $2200 to an attorney which we do not have right now.

    We tried getting our home refinanced so that the bankruptcy could be paid off but the bank is showing on our credit report that we are in foreclosure. Every payment to Chase has been made on time since we filed in 2003, so is there a way for me to negotiate with them regarding the $8K? We can make 1 1/2 payments a month for one year to pay them off. My biggest worry is that we could lose our home because of my mistake.

    Chase attorney (collection firm) are sharks. We have not received a letter from them but I know we will sometime this week. They will give us 30 days to come up with the $8K and if they don't the foreclosure proceedings will start.

    Is there a place where we could get a loan to pay off the $8K? What am I to do? HELP!

    Question? What do you mean former Attorney? What happened to the one who filed your case for you? I was under the impression that Your Attorney was your Attorney throughout the whole bankruptcy.

    If this was your Attorney, why isn't it still your Attorney? Please Explain..
    Your lawer should have filed an objection.


    Anyone correct me if I am wrong...

      Is Chase using those vermin known as "Codillus and Stawarski"?, I forget the exact spelling, they are faceless vermin. Disgusting scheisters who rack up legal fees like the meter is running.
