I didn't file, husband did. Now SEARS on my credit report.

My husband filed ch.7 and Sears was included. I did not file as we thought all the debt was only in his name. And we assumed that even if a creditor had my name somewhere on the account, that my husband's ch. 7 would still wipe out all the debt. The Sears balance was around $4K. I had forgotten that I had a card in my name, so they must have put it as a joint account. I wish I had noticed this months ago. I am doing much better nowadays in following our credit scores.

How do I get Sears off of my credit report? I hope this is possible. I am not working. What are the chances that they'll come after me or continue to bring down my credit? I want this off for good--and not showing a negative mark!

    help!

If it was a joint a account of some kind, there is not much you can do?

However, you should still issue disputes to all the CRA's informing them that it is not your account, and see what happens with the verifications.

If you are monitoring your Credit, check to see if that acct is listed as Joint of if you are just and Authorized User.

Either way, you can try HHM's strategy and see if it works. Dispute as "Not Mine" and see what happens. The CRA's may remove it from your Credit Reports.

We've done that with all accts where one of us was the primary and the other was AU and it seems to work. Also, Sears may fail to respond in the 30 days allowed. If that happens, the CRA's will remove the acct too.

I did join truecredit (thru the Walmart link) in Dec. for my husband and then a few days ago for myself. It's $11.21 per month (wish there was a joint package?) but worth it right now.

So I went thru my credit report and sent notices to correct errors. I did note that the Sears acct. was filed in a ch. 7 in 'someone elses' case---or maybe I put 'not mine'. I should be hearing back in a few weeks.

Except one of the credit reporting agencies doesn't allow online corrections. I will contact them by mail if I have to.

If you didn't file BK, they can not report it on your credit file. I jumped through a million hoops several years ago when my DH's ex filed and they made the BK notation on hubby's credit report. It's illegal for them to report someone else's bankruptcy on your report - it is tied to the social security number and not the account number.

If they don't respond the first time with removing it, send another letter to the CRA, Sears, and copies to anyone that oversees their credit reporting.
