    Car sale / purchase question

    As I had stated in a previous post, my caravan is dying FAST. It has major transmission issues and will cost more than it is worth to fix. I have chosen an attorney and have told him about the 2 cars I own. One being the 95 caravan which is my main car and the other is a 94 tracker that is sitting in my driveway with a broken drivers door, no muffler and steering problems. As of a couple months ago it has not been driveable due to the steering. I havent signed any bk petition yet (am getting my counseling certificate AGAIN) but plan to do so the end of next month when I will have the lawyer's money.
    Being that I havent filed yet or paid my attorney yet (only consultations so far but, he has drawn the papers up..just waiting on the cash, counseling certificate & my signature) would it be possible to sell both my clunkers (i could probably get about $800 combined for them, and use that money to purchase ONE decent running car? I had thought about making payments at an aquantances buy here pay here lot, but I think I might be better off finding a good 'winter car' for about $1000 and not taking on anymore monthly debts prior to filing. I found a good car in that price range and I will need to move fast if I want it. Would the trustee consider a sale & purchase like this a necessity?? I need to get to work as I am the sole breadwinner here.

    You can go ahead and carry out the transactions. They are considered necessity and will have no consequence on your Bk filing.

      Wow! That is some outstanding thinking..seriously, do you have any idea how many people post on this forum trying to figure out ways to keep their $560 car payment? It blows my mind....It is like they will never learn..oh well..


      I bought a '92 Ford Taurus wagon with 145K on it ($800) and drive it 56 miles round trip every day...runs fine, heater works, cruise works, power windows work, everything works and it passed state inspection no problem. Got it from a local high school that had it donated to their automotive repair program...good luck with your car..you are making a really smart financial decison.....

        Transportation is a necessity that would be understood by the Court. Go ahead and do what you need to to get yourself some reliable, safe transportation.
