i am considering filing chapter 7. i am divorced. however at least one (but maybe a few more) or my debts are in my name and my ex-husbands name. so i guess i should list him as a co-debtor? my question is, does he then get notice of my bankruptcy filing? can he challenge it? we've divorced so clearly the relationship is sour! i really don't want him in my business at this point but i dont know how to do it otherwise. please help!

If you care about his credit being negatively impacted, you may want to contact him directly or let your attorney do it. I'm in Tennessee so it may be different where you live, but I have an estranged husband whom I haven't seen or heard from in ages. We have very few joint debts but my lawyer told me that my individual filing would relieve me of having to pay the joint debts but that my missing husband could and would still be pursued for these debts. So if you've parted on a sour note anyway, I wouldn't even show him the courtesy of informing him about your bankruptcy. He'll just get stuck with the debts that you no longer have to pay!! That may sound wrong of me but my ex really put me through a lot and clearly didn't deserve any courtesy!
