    Joint bank accounts

    Hello,

    My husband and I recently separated and I am considering BK individually. He can't file BK, because he filed 4 years ago. He opend a bank account and added me on later. He is the primary on the account. He has about $2,000 in there. If I file BK could the trustee go after him, because I am also on the account. Do I need to inform the trustee about this joint account, even if I am not the primary?

    Are you divorced or merely seperated?

    Typically what happens is that a couple gets divorced THEN, one, the other, or both, turn around and file BK after the Divorce.

    If divorce is inevitable, its much easier and cleaner to file the Bankruptcy after the divroce.

      We are merely separated and not discussed divorced yet. He lives in another state. He can't file BK only I can. Will the Trustee go after the money he has in the account. Do I need to inform the trustee about this joint account, even if I am not the primary?

        Hi,

        Do you withdraw/deposit money into this account? Tell your "ex" to have your name removed from this account, or do so yourself. Or just don't list the account on your BK petition, and simply list your individual accounts.
