    Newbie Here...2006 Income Taxes - What To Do?

    I'm new to the site and found it last week. I've found some very useful information so far but I'm still unsure about what to do with my taxes this year.

    I filed bk in 2005 and it was not signed and closed until January 2006. Last year they told me it would apply to this year's taxes and that I would get something but I haven't. I've noticed a few threads on this site that says you don't have to show the bk on taxes and a couple of other people have said that also.

    Bottom line...I'm wondering since the debts discharged were all credit cards and I reaffirmed on my house and car and I haven't gotten a 1099 or anything else and my case was closed...do I have to report anything to the IRS? I'm sure hoping that I don't have to show the discharged debt as income but I've heard that too. If I couldn't pay for it then, why would it be income now.

    In fact, the bankruptcy trustee files a tax return for the bankruptcy estate. Thus, you file your taxes as if it never happened. However, if you have been paying on the house, you should get a statement from the mortgage company about how much interest you have paid. But other than that, you will not get any 1099's from any creditor.

    Income tax on forgiven debt is just that, for "forgiven" debt. A bankruptcy "discharges" debt, the creditors do not have a choice in the mater. Discharged debt is not taxed as income.
