    Buying a house while in Chapter 13

    I filed a Chapter 13 to pay off old debts associated with my ex-husband and our marriage. I would like to buy a house with my fiance when we get married. Is it possible for me to be included on the loan and title if I am still paying on the Chapter 13? If not, would my fiance be able to pay off the plan early without me having to pay 100% to the unsecured creditors? Does the trustee and the court allow someone else to pay off my plan?

    Well, if you were included on the loan, you would have to get permission from the court.

    As for paying off, the trustee will want to get as much money as possible.

      If I get permission from the court to purchase a house with my new husband, it is possible that the trustee would allow it? Next, if I apply the same amount that I pay in rent towards a house payment, is the court more agreeable?

      Most of my debts are unsecured (medical which are actually under my ex-husbands name as guarantor, credit cards). We had taxes which he was assigned during the divorce. However, he is now incarcerated and not paying any of the debts or child support (over $22k). I have rolled the secured and priority into the plan for 48 months.

      Would, or has, a trustee allowed a fiance, or new spouse, to pay off on another's plan early? If so, is the pay off the same plan amount or does the other person have to pay the unsecured creditors as well?
