    341 was today...Phew!

    I haven't posted since August of last year but thought I would take a moment to share my experience so far.

    It took my attorney FOREVER to get the case filed - from August 06 until January 07!! During that time, someone who had sued me in another state ended up with a sizeable default judgement. (I was unable to respond because of the exorbitant cost to hire an atty in that state). Purpose of BK was to stop the lawsuit in its tracks as well as dispose of business debts for which I was personal guarantor. Needless to say, I was not happy about the default judgement because, had I had the money to fight, I feel sure I would absolutely have won the case.

    Anyway, had my 341 today and I must say, the trustee was a very kind and considerate man. There was an elderly couple before me and the woman was obviously upset - he put her at ease by cracking a joke. Advised their lawyer on what he should file for them etc.

    Came to my case and the rat who sued me had a local atty present. I was absolutely on verge of a panic attack, but managed to keep it together.

    All in all, it was not a bad experience at all. Embarrassing, humiliating.....yes....but not as painful as I had expected it to be.

    Now, case is continued pending additional (minor) information to be provided to US Trustee and the Trustee (yes, US Trustee got involved last week).

    Lawsuit dude's atty asked for more information about company assets - which I would think are outside of this bk since I filed on my own behalf and not that of the corp. This part is what I am the most worried about since I don't think my bk will be the end of the matter.

    I just want to get this all behind me so I can finally move on with my life after 2 years of hell.
