To protect Mom

I am on the verge of filing BK 13. I have a CC that me and mom have had for 10 years. The balence had been 0 for many years untill 3 mo ago when they sent me some checks that had an APR of 3.99 for the life of the bal so I transferd $8K from other cards to this one with the intent to pay it off in 4 years.Well best laid plans fail. Mom is primary card holder.

Now I need to file I dont want to screw mom so I have filled out the form to remove her from this card but I dont think the CC company will do this. Why would they?

I need to file before 10/9/04 as I am getting married and I dont want to get her involved in this BK.

So I plan on in efect reverseing the balence transfer by tranfering the $8K to 4 other CC @ $2K each. I need to do this ASAP like in the morning.

With me filing so close to this tranfer will this efect things much?

Thanks for the input!

If she is primary, they can't take her off, only you. They would only take her off if she's a n authorized use, not a co-signer or primary.

I wouldn't be transfering anything until you clear this with your attorney. It could be viewed as fraudulent and your bk case can be dismissed. I think regardless, your mother will be on the hook for the balance (if she's the primary) if you file for BK.

Good Luck!
