    attorney vs cheaper legal help

    My husband owns a small business. If we file Chapt 7, will the business be affected? Also, I'm thinking of going to a place that prepares the paper work instead of an attorney (because of the difference in cost). Is an attorney really worth the extra $600?

    Whether you need an attorney depends on how complicated your situation is and how willing you are to research.

    I would say that with a small business involved and your husband being self employed, you SHOULD hire an attorney.

    Those that prepare paperwork do not give you any legal advice.

      This really depends on the attorney, and what your expections are. You should interview at least four different attorneys (this is done during your "free initial consult") You'll want to clarify your expections during this time.........to gauge whether or not the attorney will be a good fit for you two.

        Thanks for the advice. We talked to some other people as well and I don't think we will have any problems without a lawyer. I am planning to get the paperwork myself and see how that goes. If I need a lawyer at that time, then I should be able to afford one...better than now anyway and I am very anxious to get this is motion.

          My point was not so much directed on whether you need a lawyer to fill out your paperwork, that is part of their job but only a minor part, but you should seek a lawyer to advise you about what will happen in BK given your circumstances. When someone is self-employed and have their own business, an individual BK gets rather complicated as far as the legal implications.

            Oh, I understood that. In fact, the lawyer I talked to made it clear that I have to do the paperwork myself in any case. He will just be there to help in anything we don't understand and give us legal advice. I'm getting the paperwork today and if there is anything there that makes me leary, then I will go thru the lawyer.

            One more question, tho....can I go to court by myself when the date is set or does hubby have to appear. I hate for him to have to close the shop for the time we are gone...seems like anytime it has to be closed, he loses business.

              If its a joint BK, then both of you need to go the 341 Creditors Meeting, depending on the Trustee, you may be able to arrange an alternate appearance to better fit your husbands schedule, but that will depend on the Trustee in your area.
