ok, now i'm in a panic. my husband lost his job today...and i don't think we can make our payment this month. we are 7 months out on a chapter 13...been in it for in it for 42 months now. we have already paid the percentage to our unsecured who filed a claim per our confirmed plan and are now paying the remainder of the base amount, paying more to those who filed a claim than originally agreed to. is it possible for the court to make an exception and allow us to pay out early based on our current predicament? and if we roll it into a 7...will we lose the vehicles that we have that were part of the plan? i am so scared and i cannot get my attorney to call me back!

The trustee should be willing to work with you to get remaining payments paid. Worse cause senario they will take you make to court, and you can explain your situation to the magistrate, you should be ok. They will work it out with you. Don't try to pay it out thought, she get a agreed order to get back on track. If you pay it out, they might add additional months to plan.

thank you for that. i finally got to talk to my attorney today, and though she couldn't get into the court system to look at our case information she said that it would all be ok. she said they will ask for early discharge, considering our situation..and the fact that we only have 7 more payments, and we have never had any problems during the course of our plan. they will try to get the remainder reduced. and, she said that since we have come so far that we will not have to change it to a 7. i feel a little better, but i really just need to see how it all works out. my husband losing his job, it was very very unexpected!
