    Judgment Nonsense

    BK was discharged in October '05. Today I find out after going thru BK papers that a hospital bill for 13290 dollars was not on my Schedule F! And this bill is listed as a judgment on my CR! The weird thing is that they filed it with the court the same month as my BK. Is this possible? Wouldnt my BK have wiped it away before they could have a judgment entered? My schedule F shows a judgment from the same court for a different medical bill from the same creditor. Anyone have a clue how I should proceed?

    Depending on the state you live in and their previous court decisions about the discharge status of creditors like this accidentally left off when you filed, since the hospital debt would have been discharged if it had been listed, it would be considered wiped out. In other states, the court may ask you to reopen your case to add this creditor.

    If you filed your Ch 7 with a lawyer, call him/her to get an opinion. If you filed on your own or didn't like your lawyer, call and make appointments for free consultations with 2-3 experienced bk lawyers to get their opinions about what you can do in your state.

    It's worth a try to copy your Ch 7 discharge/closing papers and send them to the hospital. They may wipe your bill out after seeing that alone.
