I was starting to help my friend do her Chapter 7 paperwork, when I came across this:
An individual cannot file under chapter 7 or any other chapter, however, if during the preceding 180 days a prior bankruptcy petition was dismissed due to the debtor's willful failure to appear before the court or comply with orders of the court...
Her Chapter 13 case was dismissed in December because she couldn't afford the Trustee payments. Does this count under that above rule? It seems no, but...it's all confusing! Normally I'm sure she would wait one more month, but as per my previous post she's trying to get another month out of the house if at all possible...
