    Curiosity question

    Hello,

    I had my meeting with the trustee on March 26th. The trustee took over my vehicle and is in the process of selling it at an auction. Due to taxes, I also had to pay a few hundred dollars, which has been paid and the check has already been cashed. Here is where I got a little confused:

    Today I received the notices that were sent out to the creditors in order for them to make a claim in order to receive a portion of the monies paid to the trustee. The deadline for them to submit their claims is stated to be July 26th. Does this mean that I will have to wait until all claims have been made and the monies distributed before I get my discharge??? I was hoping to receive the discharge by the 2 month deadline.

    If anyone can answer this, it would be appreciated.

    I started to post this exact question this afternoon. We are a few days behind you in the process (341 was on 4/13). We got that same letter today in the mail. I called my attny and he said the discharge will be 60 days after 341, that later date (ours was 7/29) was the deadline for creditors to have their notification that they want a portion of your assets. Has nothing to do with day 60...that is for objections! Hope that helps you....funny Ihad the same exact question earlier today!

      Yep,............ Hopeful is right.

      Your 60 Days for Objections and Extensions is one timeline. Really the only one you need to be concerned with. If none pop up, you should get Discharged right on schedule.

      The other date is between your Creditors and the Trustee.

      The only part being an Asset Case will slow down for you is Closing. The Trustee will have to wait until 7/29 to see which Creditors ask for a piece of you Asset pie. Then the Trustee will have to decide who gets how much and pay each one. After that, the Trustee will perform an Audit of your Case and issue a Final Report of Distribution of Assets. Then the Trustee can Close your BK.

      Discharged - 12/2006
      Officially Declared No Asset - 03/2007
      Closed - 04/2007
