    Chapter 7 Need Advise!

    I RECENTLY FILED CHAPTER 7 ON APRIL 4, 2005. I HAVE OVER $27,000 IN CREDIT CARD DEBT, JOINTLY W/ WIFE. EVERY PAYCHECK IS ALREADY OWED WHEN WE RECEIVE IT. MARRAIGE IS STRAINED AND MAY BE OVER. WE AGREED EVEN IF WE STAY TOGHETER WE NEED RELEIVE. BEFORE THIS CONVERSATION I HAD MADE A NEW PURCHASE ON A NEW CREDIT CARD ISSUED TO ME AT AN ELECTRONIC STORE. THEY GAVE ME $5,000 CREDIT ON THE SPOT. I SPENT $2,300 ON PLASMA TV. ABOUT 3 WEEKS AFTER PURCHASE MY WIFE ANNOUNCED TO ME HER INTENTION OF LEAVING ME BECAUSE OUR RELATIONSHIP WAS SEVERLY STRAINED TO THE POINT SHE WAS LEAVING. I DON'T KNOW IF THIS PURCHASE WILL BE A PROBLEM? WILL THEY SEE THIS AS AN ATTEMP TO DEFRAUD THIS CREDIT CARD. THE MERCHANDISE IS NOT RETURNABLE IT'S THE STORE POLICY. I DON'T KNOW WHAT WILL HAPPEN? ANYONE WITH ADVISE PLEASE RESPOND.

    I am no expert (meaning you probably want to talk to an attorney), but I beleive they look at combined purchases before you file. This means if you have been running up debt on several accounts and in large figures (greater than $6000 comes to mind), you might be in trouble. In the end though I believe it is up to the credit company to file a complaint with the court then the trustee might do a little digging. Doubtful they will do this though. All the attorneys fees would far outway the grand or so they might get back on the TV.

        March 13, 2005. Another thing, I just found out that an automatic payment that is on one of the cards I listed was charged for my XM Radio subscription on March 15, 2005. What can I do? Help!

          answer

          Usually new debts within 90days of filing, they won't let you include them. I would suggest you stop using them wait for 60-90 days, if you can , and then file. Otherwise you will probably have to pay it.

            Your either going to have to continue to pay the debt for the TV, or give it back, and even then, the deficiency balance may not be discharged.
