Woah... 341 is coming up on Thursday already!

It seems like forever but it's also gone by so fast... weird. I can't believe our 341 meeting is on Thursday. I think we have everything lined up that our attorney has asked for, but am concerned they will ask for more. We don't have anything, really, but stuff that is already secured. Just typical nervousness I guess. I suppose the scary 341's are the ones that really stick out in my mind. I'd love to hear from easy breezy 341's!!!

Our Ch 13 lawyer told us that if there is anything that the trustee requests and we don't have it at hand, he'll just continue the case to another date to give us time to gather up what he wants. I went to our 341 with a whole file of stuff and our paycheck stubs received since we filed which he did request we bring along. Our trustee didn't ask for a single thing, including the paycheck stubs. All my nerves ended up being a big nothing! Odds are 99% your worries will end up being just a big nothing too!

Hang in there - be sure to let us know how your 341 goes on Thursday. Good luck!
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED

My husband and I filed Chapter 7. Our attorney told us all we needed to bring were identification & social security cards. At that time, I had no idea about these forums, so we did as he told us. Thankfully, we didn't need anything else!

The court was running over an hour behind, so we stood in and watched several cases before ours. I was a little worried that the trustee seemed pretty strict. It didn't help that our attorney's paralegal had previously told us that out of the 2 or 3 trustees, that he was the one we didn't want!

I was so nervous! When they called our names, my knees were shaking so bad I wasn't sure if I could walk up there! LOL It ended up taking us less than 5 minutes. I don't even remember what questions he asked! My husband works at a local conference center (a few streets away from the courthouse) that has been in the news a lot. Local gossip, ya know...The trustee seemed more interested in that than our bankruptcy! Whatever! I was just glad things went smoothly! I was even surprised when he told us to have a nice day...I didn't realize it would be over so quckly and painlessly!

Good luck on Thursday! Just think of how happy you'll be after those few minutes!

I wagged our big file of stuff with us to our 341 just in case. Didn't need anything. The Trustee and our attny even shot a few jokes with one another back and forth.

It was quick but not "perfectly" painless like I had hoped. The Trustee held over our No Asset report until he saw our filed taxes this spring. We filed in Sept with our 341 in October, so the Trustee was looking for income tax refund money to claim.

But we didn't get much refund. So a couple of weeks after we submitted our filed income taxes, the Trustee abandon our refunds.

          That was our only snag.

Waiting an extra month after the No Asset report was filed to be Closed was almost worse than waiting out the 60 days.
          Filed Ch 7 - 09/06
          Discharged - 12/2006
Officially Declared No Asset - 03/2007
          Closed - 04/2007

I am not an attorney. My comments are based on personal experience and research. Always consult an attorney in your area to address concerns related to your particular situation.

              Hey,

Don't worry too much. I had my 341 in March and I'm in the same state so we probably went to the same room! Make some friendly conversation with the security guys at the front door. They are nice older guys

Once you get there and your att. briefs you (if you hired a lawyer) go ahead in the hearing room and you will get a hang of how things go.

My 341 lasted 5 minutes and that was the longest hearing the whole hour. Mine was a bit long because I had a small business and the trustee had some questions about inventory. The whole thing was very laid back and pleasant, really.

Once my hearing was over, I smiled and waved to my attorney and was walking (singing "it's too good to be true" ) toward my car. The next day, the trustee declared no assets and my discharge came with no hitch.

You'll be fine. If you are appearing at the Courthouse in OKC enjoy the pictures and architecture. This may sound weird but try to enjoy it. After all, if this turns out the way it should, you take a huge step toward FREEDOM!!!!

Have no fear - if you turned over all your info, and are not hiding anything - it is pretty swift and painless. If you don't get called first, sit in on some and get a sense of what the trustee asks each case and you will have your answers at the ready.

I took a book with me to read while waiting. I sat near the front so I could also hear what the other cases sounded like. It was over in about 5 minutes. The only thing trustee was interested in was land I own attached to my home lot and I had declared that it was landlocked and he wanted to make sure no one could get into the land except for going through my back yard. I get to keep the land. Right now I am awaiting a meeting this week on a reaffirmation I set up. I filed pro se.

                      Hey Fellow Okie!

Just wanted to wish you the best Thursday. Knock 'em dead!

Pacer entries are a bit tardy in OK so don't sweat. Sounds like your attoney is on the ball. Mine was too!

Let us know how it goes.
