    Good Morning....... Just wanted to update on the reciepts we need for the trustee. We just picked them up at our bank and it isn't as bad as it looks, we have reciepts for things I had forgotten about, bascially furniture and such. We still have maybe about 23K to explain, but most of that is into check places, and normal living. I spoke to our attorney yesterday and he did assure me that this case will drag into the end of this year, as this trustee is looking for money. Let him look, we have none, I have been beyond honest with this trustee, and you would think with as fast as we return papers to him, he would know we have nothing to hide and our attorney keeps telling him that, so if this is going to drag out for the rest of this year, I can no longer allow this to rule my life, this trustee is just a person and they really can only take things, I'd loved to keep them, but I love my husband more and his peace of mind is worth more then anything and everything we own. I am thinking of putting in a explantion maybe explaining why we had such large withdrawals, if anyone should understand checks places don't take your check, it should be them, do u think it would help, and just what should I say. thank you so much to all of you that have replyed to my posts, oh my husband is going to try and get something from the check places today.

    Good for you, Nancy! This is the best mental attitude to adopt to get through filing to discharge and closing! Keep your eyes on the final prize - being together, not allowing the "stuff" to become more important than each other, and being debt-free to start fresh again! You go, girl!

    If your lawyer thinks this is a good idea, then go ahead, but be sure to clear this with him first. Frankly, I would focus on gathering any documentation in case you need it. If the trustee wants an explanation about the cash withdrawals, he/she will ask for it and then you'll have the documentation ready to go. I guarantee it's not the first time the trustee has seen cash withdrawals before, and documentation about where the cash went is likely what they will request even if you've already given a written explanation.

      Thanks, I hope we are doing the right thing, we have few reciepts, seeing that he wants to know about money that was spent in 2004, luckly I keep a journal and I looked back at them and saw we got a box spring and mattress, and other stuff we forgot about, plus a portion of it went to cash places and today so many told us they don't keep records back that far, one was nice and went way back in his "paper "files and got them for us. So we'll explan what we can, and hope on the rest, I wonder how many people really keep reciepts for all the little stuff they buy. But thanks again for your sweet reply. I'll keep all updated, boy I sure do hope this will be enough.

        2004 is only 3 years, they could still be audited by the IRS, so I'm surprised they don't have the records. I'd discuss with your lawyer, perhaps look through your journal some more. See if you made any mention of an amount in the journal and a place. You could at least provide the trustee with the name of the business if your lawyer thinks its a good idea and hopefully approximate what you paid them.

        July 2nd, 2007: 341 Meeting Held
        September 4th, 2007: Discharged and Closed.

          JRSCOTT, thanks for the input. We have already supplied the trustees office with the names and addresses of the payday loan stores, with to the best of our knowledge the amounts we have paid, if they want to accept this fine, if they don't well I have done the best I can, I truly don't believe that they will never ever be happy with anything we submitt anyways. I have been so honest with this trustees office we even included gifts that were bought on this money, what they were, how much and were I bought them. I find it hard to believe that they expect people to actually keep reciepts for gifts and food and all the little things of life, I wonder if they do. So the ball is in there court now and I hope they accept this, even our attorney said he wouldn't have reciepts from this long ago, you know when you think about it, our attorneys, trustees may all only be a bad judgement call away from bankruptcy themselfs one day. I'll keep you updated
