    Negative Credit Reporting

    I just pulled mine and my husbands credit reports from all 3 bureaus to find out that some of our creditors have been negatively reporting. WE filed a Chapter 13 in April of 2002, in which our vehicle loan was included to be paid through the plan. In March of 2005 we filed to convert to a Chapter 7. I see that the bank holding the loan for our vehicle has been reporting 120 days late every month since April 2002, can they do this if it was included to be paid through the plan? My credit score is 550, and I am sure it would be better if I didn't have that showing up. Any advise on how I can clear this up would be greatly appreciated.

    Is it 120 days late, did you ever miss a monthly payment?

      It was being paid for through the Chapter 13 plan. Prior to filing 1 was late 1 time - 30 days. The courts ordered only 13,075 to be paid to them and the rest as an unsecured claim. Payment was $468.91 originally prior to filing, and my monthly payment to trustee was $464.70/bi-weekly. So they probably didn't get complete payment everymonth as towhat their payment was originally, but I didn't default on the Chapter 13 plan, all payments were made as agreed (motion to suspend and add to end was done when I had my child, but courts approved this order). So to answer your question, I wouldn't consider it late but don't know how the legal process works.
