Just Lost Judgement To EDD

I just received a letter on April 13th called a Memo of Costs After Judgement. They state that a withholding order is in process and they will be taking approximately 25% of my net pay. I only make $300 per week and was thinking about filing ch 13 which is the only way I can stop this. Problem is it will cost around $200 to have someone like bankruptcyparalegalservices,com or rapidbankruptcy to prepare the paperwork. Plus an additional $200 to file, is there any alterantive. I was hoping to by some time to save the money to do this 30 or 60 days but am lost. I live in Los Angeles but the court this is through is in Sacramento.Everything I have received is throught the mail, there is no option for me to show up in court, so I don't know how to respond. Please any advice would be appreciated.

You're best protection would be from a BK's automatic stay. But if money problems is making it difficult for you to file BK, then submit an appeal to the courts.

Thx for the reply, how would I go about the appeal. Should I just send a written certified letter with the request to the court in Sacramento? Or is there a certain formal form that I should use?

Just contact the courts clerks or information services offices for information about filing an appeal. But keep in mind that "they" will not be able to provide you with legal advice.

Hey One,

Haven't you heard? If you are really broke you cannot file Bankruptcy.. You have to have money to file for bankruptcy. After you give your money to the court and the lawyers you find out that if you earn more money than you need to live on after you debts are wiped out than you do not qualify to file anyway. It seems to me that the real crooks are dressed in sheeps clothing if you know what I mean. I can't understand why they need to change the laws.

If I where you I would just quit my job and move. You can't possibly live in California on $300.00 a week anyway can you?

Would not the EDD need to file its complante in the county the action happened in. If he filed for unemployment in LA should the case be filed in LA too?
