    ACK! Our house listed in forclosure.com!

    Why would our house be listed in foreclosure.com? Yes, it's showing as bankruptcy, but what does this mean??? Can someone come and buy it out from under us??? We haven't received reaffirmation papers on it but at the 341 we stated our intent to reaffirm and it is on our original filing that we intended to reaffirm. They have been doing automatic withdrawls each month like usual... I'm freaking out here! Help!
    3/27/07: Chapter 7 Filed - Pre-filing true FICO (hers/his) 450/477
    5/10/07: 341 Meeting DONE! Trustee's Report of No Distribution Filed
    7/04/07: FICOs going up! Credit report cleanup (hers/his) 540/536
    7/10/07: DISCHARGED! 8/27/07: CLOSED!

    I'm not sure HOW a property gets listed there, but presume the bank/lienholder has something to do with it. I believe there are a couple of areas to foreclosure.com, seems like one is 'pre-foreclosure' listings and the other are scheduled sales. Make sure yours isn't in the scheduled list.

    Ah, ongoing reaffirmation efforts! Look, the forums here are riddled with intent to reaffirm. Including that in your filing petition does NOT make it happen. The reaffirmation process requires you and your attorney to get involved with the bank and make sure that reaffirmation agreement is executed and signed by the bank before your discharge. Else, it won't happen - and anyways the bank has to agree to it - they aren't obligated to accept a reaffirmation. If you haven't communicated a reaffirmation request directly to the bank, do so at once. The fact that they are still taking payments out of your account doesn't mean anything except they still know how to get your money and you aren't stopping them. I wouldn't make another payment until you knew you can save your home.

    But no one is going to buy your house out from under you. Depending on the state you live in, the process can take anywhere from 30/40 days to as much as a year. GET TO KNOW YOUR STATES LAWS ON THIS SUBJECT. You WILL be notified before a sale is scheduled, and it will be a public sale usually on the courthouse steps.

      I just went and looked at that site and my house is listed there too . And we plan to reaffirmation also but no papers yet either maybe I will call my lawyer tomorrow to see what all that means now I am worried as heck too ! I am so glad I check here everyday and read I am always learning something new I don't post much but I read alot.

        I saw my house on there the other day and I don't even OWN it!! I checked pacer for my landlord and they aren't listed, so I know that its me! Thats really weird!!

          Maybe the slimebags at forclosure.com do nothing more than simply list the address of anyone who files BK, figuing that many will end up surrendering their property as well?

          Either way, what poorme says is sage advice. Check with lawyers and make sure everything is on paper in black and white. I know we will when we do file.

            I guess I just thought they sent the reaffirmation agreements to us directly since that's what both of our car loan banks did. So you have to ask for them? Wonder why my attorney didn't say anything when he handed me the two for the cars??? I asked him if we needed to reaffirm, if just paying them would be fine, that they won't take your car/home if you keep paying because all they want is money. So I guess I need to check on that?

            ETA - My mortgage is through Chase Manhattan Mortgage (it's a rural development loan, so I think it's government backed?)

              Take nothing for granted. I'm an advocate of pressing your attorney to make sure he/she does their job, ask them the 'hard' questions every now and then - it's OK to do that. Maybe yours is on top of things and that's how the cars got done, but a house is not a car - there are way bigger bucks at stake. Make sure the bank was sent the papers and have him follow up with them to see when they will get them back to you - else you call the bank and ask. You've got to have their signed agreement before your d/c, because technically the rules change at that point. I hope this works out for you.

                now that's funny we have two cars one we are keeping and the other we are letting go Lawyer had has sign papers for th one we are letting go but not anything for the one that we are keeping I wonder why hat is I wonder if things are different from state to state .But then again the house isn't they are all on forclosure.com

                  And I also noticed on our credit report 2 are saying Derogatory" for the "Condition and one says nothing on our house i wonder what that is all about

                      Yes it's crazy mine says the same stuff I will see what is reports again after the 60 days Right now I just worry about the house .Hope I can sleep tonight.
