    State Sales/Use Tax

    Hello,
I filed CH. 7 in May of 2004 and my case was discharged in Aug 2004. I am now receiving notices from the State DOR telling me I owe sales tax on vehicles purchased out of state since they did not collect 7%. It turns out they collected only 4%. These vehicles were purchased almost a year and a half prior to my BK. I contacted my lawyers office a few weeks ago and my his paralegal told me that since I purchased the vehicles prior to filing and had a "no asset case" that I was not liable for these taxes. I sent a letter to the DOR referencing this and they seem to think I am still liable for them. Any advice? If it matters the vehicles were purchased in FL and I live and filed in the state of GA. Thanks for the help.

Have your Ch 7 lawyer send them a letter stating you are not responsible for the taxes. That should do it (You will likely have to pay him/her for their time, but if that's less than the taxes owed, it's worth it!)
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
