I am going pro-se. I know its not a good idea but, I have lost faith in the lawyers around here. They seamed to be working for the creditors instead of me. I will probably get pounded in the 341 meeting, but I will be damned if I am going to give some rich ass Lawyer what few dollars I have left. I would rather give it back to creditors.
Questions:
1) When accounts have been "charged off" and sold to collection companies should I list both even though it is the same account.
2) If I surrender my home to foreclosure. and if there is equity no matter how small should I also list it as an asset? I am thinking NO but I am not sure.
3) My foreclosure papers state 5 different company names i.e Ameriquest, AMC Mortgage, Argent Mortgage Co., but the debt is stated to be owed to Deutsch Bank National Trust, as trustees for Argent Securites, Inc. And then there is an Attorney in fact. I am sure that they are going to screw me over if I don't list the proper one(s). What should I do?
4) I am thinking maybe I should call the foreclosing Attorneys and offer "Deed in Leiu of" to avoid the foreclosure proceedure. Is that a good idea or not?
5) Some of my unsecured creditors have small claims(less than 500.00) I could have payed some of them off, but choose to use my income to pay my monthly expenses. Could be questionable though. If asked by the trustee why I did not attempt to pay the little ones how should I respond?
6) Once I have filed my petition and paid the fees, can I enter into a contract to buy a home or land, or do I have to wait for the discharge?
7) If I need to take up a temporary residence that will not cost me anything can I still estimate the cost of a permanent residents on my living exspenses? Now that is a stupid question isn't it?
