    car payment and adequate protection

    I hope that someone can help me get clarity on this subjuect and paying the car thru my bk13 plan. When wife and I filed in 11/06 and started paying in 12/06, we made our first payment of 1100.00 but that had to be adjusted because of wife giving birth in late 11/06. Attorney adjusted payment amount to 250.00 starting 1/01/07 but to increase to 750.00 effective 12/07. Now this increase is what of 500.00 is what my normal car payments are (which is included in the plan and crammed down). I have been paying on this car for 3 years before we filed. My plan is for 5 years with 12/07 being 1 year into the plan. To me it seems as though I will be paying on the car for another 4 years for a total of 7 years. Any insight to this situation or am I just freaking out. I dont know how the 250.00 is being currenlty disbursed or if it is at all. Can anyone give me some insight if at all possible.

    Have you taken a look at your Plan disbursements??

    Some Trustees also make that info available thru their own websites. You'd have to check with your Trustee's office to see if that's available in your area.

    I've also seen another website posted where you can find Plan info. Maybe one of the 13'ers will chime in here with a link for you.

    The Trustee decides who gets paid how much and when. Just because your Plan payments are going up the amount of your car payment doesn't necessarily mean the Trustee is gonna take 5 years to pay off the car. Once the car is paid for, the Trustee will disburse the remaining monies amongst other Creditors who filed Claims in your case.

      What SinkingFast said. I was just about to post that same information.

      I had a car I had paid 2 years on before filing. I would have finished payments in 2006, however, having filed Chpt. 13 in 2003 on a 5 yr payment plan, it was "extended" out to 2008 and my car was crammed down. I've noticed that even though I have just under $5k left in my plan, my car only has about, maybe less, than $3k left on it. (I checked through the 13datacenter site that SinkingFast posted.)

      I have less due on my car than what's left in my plan, but some of that money in the plan accounts for the trustee's fee and other creditors. I've noticed on the 13 datacenter site that more monies are now being distributed to my other creditors.

      Filed: 6/2003 Confirmed: 3/2004
      Early pay off sent: 10/05/2007 - 9 months early
      11/16/2007 - Discharged!
