can someone please advise me on what a hardship discharge is? my husband and i are into the 44th month of our 50 month plan. he was terminated from his job earlier this month. my attorney had filed a motion to reduce the terms of our chapter 13 in March, we had already paid the percentage agreed to but were now just paying the remainder of the base, so that we could get rid of my piece of crap car that is becoming a burden with repair bills. we haven't heard whether or not the motion has been accepted, but at this point it won't matter because after this next payment there is no way we will be able to continue paying what we were unless some miracle job comes along that will pay what he was making prior to. he is back to work this week, but he is making half of what he was.....and he was the primary income of our household. what is a hardship discharge? would it take care of all the creditors like a regular discharge or would they be able to come after us?
