    Chapter 5?

I had my Upfront Rewards Visa call today and I told them the usual, we are filing Bk, gave them attorney info and he says, "Are you filing Chapter 5?"

Is there such a thing as chapter 5, or is he just testing me to see if we are really filing or just bluffing?

    Thanks!

Weird things happen in BK that's for sure.

No such thing as chapter 5, either the person is an idiot or just testing you.

Interestingly enough, the most pertinent chapter of the Amended Bankruptcy Code (BAPCPA) is....you guessed it....Chapter 5!

Did a quick Google search for "bankruptcy chapter 5" - amazingly got a a few legitimate hits referring to this! See http://www.caeb.uscourts.gov/data/wh...y_chapter5.pdf and http://doney.net/bkcode/ch05.htm .

Probably this is where the creditor is coming from, but it's still incredibly stupid to not know the real numbers for the consumer bankruptcy chapters!

I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

      06/01/06 - Filed Ch 13
      06/28/06 - 341 Meeting
      07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go

There is a Chapter 5 to the Bankruptcy code (actually, there are chapters 1-13), but Chapter 5 is not a Chapter under which a debtor "files" BK.
