    Lawyer said don't go to court or even call??

    Is this strange?

    I'm being sued by a creditor and they sent me a certified letter stating that my court date is August 3. I retained my bankruptcy lawyer last week but an unable to make the entire payment to file at this moment...I will be able to within about 3 weeks, however. At my appointment, my lawyer made a copy of the letter from the court and said that I wouldn't have to attend that date.

    My head was spinning from all of the information and everything, so I forgot to ask if I needed to call the court or anything when I was at my lawyer's office last week. I called today and they put me through to the paralegal on my case. I asked her if I needed to contact the court and she said no, that I didn't need to show up or let them know. She said that I'll have thirty days afterwards to file an appeal and that I'll just need to have the bankruptcy completed by then.

    Does this sound right? I guess it seems strange to me to just not show up in court and not let anyone know??

    going to court wont stop the judgement. so weather or not you go to court you get the judgment against you. I would not tell them you intend to file bk until you have filed, So yes it does sound right so make sure you file bk asap chapter 7 will wipe out the judgement anyways
    Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

        You don't need to do anything, because frankly, there is nothing you can do.

        You "could" file a Notice of Intent to File BK with the court in which the creditor is sueing, but since you are going to file within the next month anyway, you probably don't need to go to the trouble.
