    "Credit Card services" -Your rights - please read

    Many of us are not sure when or if we will file BK. This then leads to a period of time when we need to deal with collectors. Here is some interesting information.

    In the West, many credit card companies are conected to "Credit card Services." This service monitors your account and can/will call when you are 30 - 45 days late. They are always cordial and friendly. "Nice" folks. What I am hearing on this "company" is they are simply a service that is hired by your creditor. What you need to know, "They are not a creditor!" You have no obligation to speak with them. They have not been assigned to collect your debt nor have they been sold your debt. They are a third party that has been given information about your debt. In fact, they may have been given your SSN illegally! Depending on your state laws these folks are considered to be third-party debt collectors. If one should call, you, turn on your recorder and proceed as follows:

    1) (You) I missed that, who am I speaking to?

    2) (You) What is your address?

    3) (Them) We're calling about your account with "so-and-so."

    4) (You) You are freaking me out. I've never heard of you. I have all contracts associated with my debt, and you are not listed.

    5) (They) who knows what "they" will say?

    6) (You) Sir/madam you are causing me concern related to theft of my identity. I'm sending a recording of this conversation to my state attorney general's office.

    7) "Click."

    I've heard that it is more-and-more common for companies, including credit unions, to hire third parties to follow up on debt. I'm pretty sure this is a big legal no-no for anyone to contact you regarding a debt, unless they have been assigned or purchased the debt. DO NOT SPEAK with these folks.

    Good information

    (Make sure its legal in your state to record before doing so, in some states they have to agree, if they refuse I'd terminate the phone call )
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.
