    Not filed yet, not answering the phone

    As the title says. We plan to file in about Nov or Dec.

    We been getting phone calls from home, work and cells. We have not responded to them in any way.

    Now will they be sending FedEx's, next day air's or certified mail to us? How about a knock at our door.

    I can't believe I stop making payments for only 2 months and this phone rings off the hook all day till about 8-9PM @ home.

    Thanks for any input.

    Why are you waiting so long?

    Do they have all your numbers on file? I only gave them my cell so they won't call work or home.

      six month of income rule is why the wait.


      As for the numbers, yea I think on the credit apps they asked for work & home numbers, so they are calling them, and I guess we put a cell number on some also.....

          At this point, you're probably still dealing with Internal Collections.

          Depending on the Creditors involved,......... Some can be more aggressive than others. Discover and Amex tend to be particularly bad.

          Generally, you'll get calls for several months. Then you'll start getting letters. Threatening letters and Settlement offer letters. In addition to the phone calls.

          At some point,......... Dependening on the Creditor involved,......... They'll turn your acct over to an outside Collections Agency.

          Being 2 months behind now,......... You should be OK to make it to Nov or Dec without anything serious happening.

          Just an FYI,........... Be sure to hang on to all correspondence, including CC bills and letters, that come from your Creditors. Your attny will want to list all addresses of contact for all CC's and Collections Agencies in your BK paperwork.

            Yup, I get about 20 or more calls a day.

            I just have a cell phone, so they call that all day long.

            I used to put the cell on "vibrate" so it wouldn't ring. But it vibrates for as long as it rings, which is annoying. So now I've discovered putting the phone on "1 beep". When the phone beeps, I look at the caller ID, if it's nobody I recognize, I don't bother to answer the phone.

            Luckily, they don't have ANY other phone numbers on me.

            I guess this will continue until Sept/Oct when I file. So I got a while yet too.

                Let your answering machine get these calls if you can....same with your cell. Put it on silent ring, and if you recognize the number than fine. Have you hired an attorney to represent you yet? If so your attorney will field these calls for you.

                Never had one (collector) knock on my door...
                Before I filed I probably got 20 to 30 calls a day about 3/4 were hang ups, the rest would leave messages....usually some automated voicebot thing saying they had an important message about my account, and to please call back at such and such number. Sometimes I would call the such and such number, to give them my attys number just to get them out of my face, and lo and behold I would get put on hold. To heck with that....

                I know it's easier said than done, but don't let this stress you out.

                Hang in there....look at the collections forum part as well on this board, it will help you with dealing with the collection calls, and knowing your rights under the Fair Debt Collection Practices Act.

                  I am current on all my bills but I know it is going to be changing very soon. I have already stopped looking at the phone & picking up the phone. Preparing myself early, just in case.

                    I mean what are you going to say & what are they going to say anyway? They will say you owe us money & I will say I had an accident, was out of work, I am broke and cannot pay.

                      Blue_Ray, all I can say is "Ditto." I'm waiting out my 6 month also and I'm hoping to get into 7 territory. If not, at least have a lower, reasonable 13 payment. I am harassed constantly and haven't made a payment since May...I'm not sure at what point they get really serious, but I think I have an attorney picked out although I have not retained him. Hopefully it doesn't get to the point where I am making a frantic phone call to him...just gonna try to wait it out.
