If you want to read the bankruptcy cases in question, here are the links to both cases - http://www.ce9.uscourts.gov/Web/bap....e?OpenDocument and http://www.njb.uscourts.gov/chambers...illingsley.pdf (Caution - much legalese ahead!Originally posted by marzipan13 View PostI want to get some copies of my transcripts while my case is pending... Where is this rule about not withholding transcripts? I tried searching online but can't find it.
The second case is specific to not withholding transcripts.)
Each school will have its own processes to get transcripts after you've filed bankruptcy including the school as one of your creditors. I would call ahead to the Registrar's Office to get the particulars. Will I need to go thru the school's lawyer or can I go straight to the registrars office and ask for them in writing?I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

Student Loans
Unfortunately your student loans don't fall under bankruptcy and there for you waiting and not making your payments is going to hurt you. Under Federal Law student loans are guaranteed by the federal government and because of this they do not fall under bankruptcy law. There fore the owner of the loan is still required to pay back what they owe even if they file bankruptcy. Any lawyer will tell you that, and your lawyer should have told you that.
