    Just filed Jan 2005. I had over $80,000.00 in CC debt - I had a few charges that where just past that 6 month line and one CC account with a laptop as an asset. Oh an 1 upside down car. I was paying over $2,000.00 each month and the balance was not moving all i was paying was interest.

    In Citibank's claim they want over $3,500.00 for a charge just past the 6 month line. Setteled with them - signed a judgment for this amount but agreed to pay $2,400.00 over 3 years and the judgment would not go in effect unless i don't make the payments. Balance is INTEREST FREE

    So would file the bk all over, you bet. I can now see light and it is getting better every day. With all the cards i had with citibank i owed them over $30,000.00 + and to have this reduced to just $2,400.00 interest free.

    Today - reafirmed the laptop - Citi Banks claim - Newer Car -
    Total Debit $17,000.00 +- monthly payments $450.00
    There is light at the end of the tunnel. Oh it is a tunnel too not just that black void of bills and more bills.

      Thanks for the info. Does anyone have an idea if quitting a job and filing a month or two later has any impact on the judge's/trustee's opinion?

        You only quit your job if you can survive without that income, its never advisable to quit a job just to file BK.

            Well, It's getting worse... slipped a few payments this past month. One cc went from 4.99% to a whopping 21.99%. Barely holding on and car insurance premium is due ($504) so I guess a few other bills will have to slip. Planning on quitting job in June and file end of July or August.

            I guess it's better than looking at the end of a loaded gun!

            Since I have no mortgage payments we can live on my wife's dsability for a while (probably better than now any way!). :o

            Just scared what October will bring when all the new laws take effect.

            BTW- Does any one know the specifics of what changes are enforced now?

              According to our attorney the BK courts in Tennessee are already implementing some of the changes in the new law; specifically, requesting more documentation to support our case. Another attorney in his firm has received several of the same requests for his clients as well. Some of the additional information they requested however, was impossible to provide, i.e., documentation to support $125 a month in entertainment. Who saves ticket stubs and/or pizza receipts? Also the request was made to provide the receipts after our 341 took place - not before. They have some wrinkles to iron out but all the fanfare suggests it will be much more difficult to file then than it is now.
