certification of compliance

I just called the trustee's office to get a list of documents I need t o send before the 341 meeting. They told me I would have to file a "certification of compliance" with the court when I sent these items to the trustee ("at least 7 days before 341 meeting")

I can't find this in the local forms or official forms, I have searched the web and can't find it. I would just pick it up from the court but it's 45 minutes away and I don't have any way to get there. My husband takes the truck to work so I'm stuck at home during the day.

Does anyone know where I can find this?

I wonder if they mean your certificate that you have completed the "Pre Bankruptcy Consumer Counseling Course". Have you taken that course, if so, did you get your certificate of completion?

It is a form you must type your self make sure at the top you put United states bankruptcy court _______ DISTRICT OF________
DEBTORS NAMES AND CASE NUMBER then put a heading certificate of compliance basically I so and so declare or certify that I have fully complied with ? on such date you get the picture . Then sign the bottom

Hmm, that's interesting... that I would have to type it myself. I did the preBK counseling and turned in that certificate with my paperwork. I still have to take the predischarge counseling. She said "cert. of compliance" had to be filed w/ the court once the documents were submitted to the trustee.

Scroll down the page. There's a Section titled "Other". About the 4th item is the Certificate of Compliance. Like HHM said, it has to do with your Certificate of Completion of Credit Counseling.

But you can access a .pdf copy there. That way, all you have to do is print it off, and type in your personal info.

I read these in Bankruptcy Rules on the gov. site. This is also what the woman at my trustee's office told me. I'm not trying to sound rude, just asking what I'm supposed to do?

It is basicly a letter stating that you have indeed complied with all of those requirements. i had to do the same thin since you are pro se you have to type it. It is no different than an affidavit except it does not have to be notorized. Not all districs require that you file this but some do. Just be sure that when you file it you put the courts name your name and case number in the right context.

That was kind of the feeling I got from searching for the Certificate. Some Courts had it listed, some Courts didn't. Evidently your Court requires the Cert.

You might want to do 2 separate ones if you're filing joint. One for you and one for your spouse.

From the Court form at the link I provided above:

"Every individual debtor must file this Exhibit D. If a joint petition is filed, each spouse must complete and file a separate Exhibit D. Check one of the five statements below and attach any documents as directed."

If you have a printer and Adobe Acrobat Reader, you could just print out the copy from the link above. Check the box for #1, sign and file that.

Put CERTIFICATE OF COMPLIANCE above the paragraph and below the case # and names but it looks right
