Our first meeting with the attorney!

We went to our free consultation today. Things went very well! She was very thorough, and asked me to drop off some more info this afternoon. (mortgage, deed, and note) She will start plugging numbers soon, and will let me know next week if she can pull off a ch7 or if we'll have to do a 13. She said she will try real hard for a 7.
She was very impressed with how knowledgable and prepared we were. <- Thanks to this board!! I already had the budget, list of creditors with addresses and amounts, 6 months pay stubs, 4 yrs tax returns, and all 3 credit reports for both of us.

She knows how the trustees work really well since she represents for them sometimes. She said "you'd be surprised how much we can do with a 13 if it comes to that. I know how the trustees work over there, you'd be really happy. But hopefully I can work out a chapter 7 so you guys can be finished with all this".

Next appt, next Friday! I will probably go a head and retain her then.

Her fee for a 7 is $900 plus the $299 filing fee and $50 credit course.
13 was the typical $3000 (paid in the bk pymts) with a $250 reatiner fee and $50 credit course.
    Filed Ch7 - 10/2/07 no asset
    341 Meeting - 10/29/07
Discharge - March 2008 forgot the date

Glad to see your first appt went well. It is great to note your post sounding so much less stressful today. I felt the same way after our first visit to the attorney we selected - just much more relieved. It sounds like you were very well-prepared.

I hope it all goes well for you. Have you given any thought to seeing another attorney or two? Since you are questionable on a 7 vs 13, it might be in your best interest to get a couple of opinions just to see what they say. It sounds like you felt pretty good about this attorney, though.

One step done... good for you!

That's great! I felt the same way after meeting our attorney the first time. It feels good to take the first step towards postive change after what we've been through.

Sounds like a good consultation, JasonK - of course, your great preparation and time spent pulling together the necessary financial information ahead of time really helped. I'm not surprised she was impressed - way to go!
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
