in jan of 07 my wife and i filed a 13 together and later that month found out that i didn't have to just my wife the case was dismissed and she filed by herself, but now the bk is on my credit report. one i was wondering if there was a was to remove it from my report and #2 will i be able to get a home loan.

Unfortunately, once you file BK, it stays on your Credit Report. Regardless of the reason for why the BK was Dismissed.
Possibly your best bet would be to hire a Credit Repair Law firm such as Lexington Law. See if they can get the BK removed from your Credit.Filed Ch 7 - 09/06
