    NJ Bk laws online?

    Ive been googling and cant find what I need. Does anyone know NJ BK laws are, esp ride throughs, reaffirms, etc?
    I guess I am a poor googler!!

    Wam, bankruptcy law is federal law - but states do have some local rules.

      What I mean is, a site containing laws regarding debtors rights by state I guess. I know what flys in say, VA doesnt fly in NJ it seems.

      Ive searched the NJ BK site. NJ is quite creditor friendly it seems.

        Ummmm... I don't think there is a "bill of rights" for debtors.

        There is the Fair Debt Collection Practices Act, which lays down the rights that a debtor has with regards to debt collection, credit reporting, etc. ... That's under the auspices of the Federal Trade Commission.

        Fair Debt Collection Practices Act As amended by Public Law 111-203, title X, 124 Stat.



        The bankruptcy law is a federal law, and covers all states. However, each state has its own set of procedural rules and perhaps local forms that are required, etc.

        And the different states do seem to be interpreting the reaffirm-redeem-surrender clause in different ways.

        A call to your court clerk may shed some light on the matter. Just ask if there are any local procedures for reaffirmation. What forms to file, etc.
